To bring the dispute before the Arbitration Court the parties shall agree in advance on this possibility by means of a clause or an arbitration agreement.

The Arbitration Court examines disputes subject to the existence of a written agreement between the parties on the transfer of the dispute having arisen or may be arisen to the court.

In accordance with clause 2 § 2 of the permanent Regulations the following clause may be used:

‘Any dispute, disagreement or claim arising out of or in connection with this Agreement (Contract), including those related to performance, breach, termination or invalidity thereof, will be settled by the Permanent Court of Arbitration of the Franco-Russian Chamber of Commerce and Industry in accordance with the Statute of Court.’
